11.1 Scope

These Terms apply to your use of our mobile application ("Mobile App") in addition to the Site. The Mobile App includes features that involve uploading a photograph of yourself for AI-assisted illustration (the "Goal Visualizer"). By using these features you agree to the additional terms in this Section 11.

11.2 Photos of Yourself Only

You may upload, submit, or otherwise transmit through the Mobile App only photographs of yourself. You expressly agree that you will not upload photographs depicting any other identifiable person, including but not limited to:

• Friends, family members, partners, ex-partners, coworkers, or acquaintances
• Public figures, celebrities, athletes, models, influencers, or politicians
• Other Mobile App users
• Children or anyone reasonably appearing to be under 18 years of age
• Persons depicted in stock photography, advertising, editorial, or commercial imagery
• Fictional characters or AI-generated personas not depicting yourself

Each time you upload a photo to the Goal Visualizer, you must complete an explicit consent attestation confirming that the photograph depicts you and that you have the right to upload it. We log this attestation, the timestamp, and your IP address and user-agent for our records.

Uploading a photograph of any other person without their explicit prior consent is a material breach of these Terms.Such conduct may also violate state and federal law, including but not limited to: the right of publicity (recognized in most U.S. states); 18 U.S.C. § 2261A (cyberstalking); state anti-impersonation statutes; the Copyright Act if the photograph is owned by a third party; and emerging state and federal anti-deepfake and non-consensual-intimate-imagery statutes (e.g., the federal TAKE IT DOWN Act, California Civil Code § 1708.86, NY Civil Rights Law §§ 52-c & 52-d, Texas SB 15, and similar laws).

11.3 Goal Visualizer is Illustrative — Not Predictive or Medical

The Goal Visualizer renders an AI-generated illustration of how you might appear at a hypothetical lower body weight. The percentage values shown are anchored to average outcomes from peer-reviewed clinical trials of FDA-approved GLP-1 medications (e.g., the STEP, SURMOUNT, and TRIUMPH trial programs). These trial means describe a study population. They are not a prediction of your individual outcome.

Goal Visualizer output is not a medical diagnosis, prognosis, or treatment plan. It does not establish a doctor-patient relationship. It does not recommend, prescribe, or endorse any peptide, dose, schedule, or provider for any individual user. Real outcomes from any medication depend on factors including individual physiology, dose response, lifestyle, concurrent conditions, medication adherence, and genetics, and may be substantially smaller than (or different from) the trial averages illustrated.

11.4 License to Process Your Photo

You retain ownership of any photograph you upload. By uploading, you grant Riley Ventures LLC a limited, worldwide, royalty-free, non-exclusive license to (a) transmit your photograph to our AI image-edit provider for the purpose of generating your visualization; (b) store the photograph and the generated images in our private cloud storage for the retention period stated in our Privacy Policy; and (c) deliver the generated images back to you. We will not use your photograph or generated images for advertising, marketing, model training, public display, or any purpose other than providing this feature to you.

11.5 Account Termination, Content Removal & Reporting

We reserve the right, in our sole discretion and without liability, to: (i) refuse to process any submission; (ii) delete any uploaded photograph or generated image at any time; (iii) suspend or permanently terminate your access to the Mobile App; and (iv) report violations to applicable platforms, hosting providers, and law enforcement, in each case if we have a reasonable basis to believe you have violated this Section 11.

11.6 Indemnity for Photo Uploads

Without limiting the general indemnification provision below (Section 14), you specifically agree to defend, indemnify, and hold harmless Riley Ventures LLC and its officers, directors, employees, agents, and service providers from any claim, demand, loss, or damages — including reasonable attorneys' fees — arising out of any photograph you upload that depicts a person other than yourself or that you do not have the right to upload.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Riley Ventures LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Personal injury or property damage resulting from your use of the Site or reliance on any information provided
• Any adverse health outcomes resulting from treatments obtained through providers found on this Site
• Unauthorized access to or alteration of your data
• Any conduct of any third party on the Site

In no event shall our total liability exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

The Site is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any dispute arising from or related to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. You agree to contact us at legal@peptideinjections.ai before filing any formal proceeding. If unresolved within thirty (30) days, either party may pursue binding arbitration.

15.2 Binding Arbitration

Any dispute that cannot be resolved informally shall be resolved exclusively through final and binding arbitrationadministered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in English in the State of Delaware. The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction.

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.You expressly waive any right to participate as a plaintiff or class member in any class action, collective action, private attorney general action, or other representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void, and the dispute shall proceed in a court of competent jurisdiction in the State of Delaware.

15.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.
